TERMS AND CONDITIONS - PERMANENT MAKEUP TATTOO SERVICES

1. Consultation and Patch Test:

1.1 Prior to any PMU tattoo service, a consultation will be conducted to discuss your preferences, expectations, and any relevant medical history.

1.2 A patch test may be administered to identify potential allergic reactions. It is essential to inform our artist of any allergies or sensitivities.

2. Consent and Release:

2.1 Clients must sign a consent form before the PMU tattoo service, acknowledging the potential risks and confirming their understanding of the procedure.

2.2 Clients release Isabel Brows Academy and its artists from any liability related to complications, reactions, or unsatisfactory results, provided the procedure is performed according to industry standards.

3. Procedure Details:

3.1 PMU tattoo services include but are not limited to eyebrow tattooing, lip tattooing, and eyeliner tattooing.

3.2 The artist will discuss the desired shape, color, and style with the client before starting the procedure.

4. Aftercare:

4.1 Clients will receive aftercare instructions to ensure proper healing and longevity of the PMU tattoo.

4.2 It is the client's responsibility to follow the aftercare instructions diligently.

5. Touch-Up Sessions:

5.1 A complimentary touch-up session may be offered within a specified period after the initial procedure to address any fading or adjustments.

5.2 Additional touch-up sessions may be subject to a fee.

6. Payments and Fees:

6.1 A non-refundable deposit is required to secure your appointment for any PMU tattoo services at Isabel Brows Academy. The deposit amount and payment details will be communicated at the time of booking.

6.2 The remaining balance for the PMU tattoo services is due on the day of the appointment.

6.3 Any additional touch-up sessions beyond the complimentary one may incur additional fees.

7. Cancellations and Rescheduling:

7.1 Clients must provide 48h in advance notice for cancellations or rescheduling. Be A Model program is a non-refundable program. 

7.2 Failure to provide timely notice may result in forfeiture of the deposit.

8. Results and Expectations:

8.1 PMU tattoo results vary among individuals. While we strive for optimal results, factors such as skin type and aftercare may influence the outcome.

8.2 Clients are encouraged to communicate openly about their expectations during the consultation to achieve the best results.

9. Health and Safety:

9.1 Clients must disclose any medical conditions, medications, or treatments that may affect the PMU tattoo procedure.

9.2 Isabel Brows Academy maintains high standards of hygiene and follows industry best practices to ensure client safety.

10. Photography and Marketing:

10.1 Photos of completed PMU tattoo services may be taken for portfolio and marketing purposes unless the client explicitly opts out in writing.

10.2 Client identity and personal information will be kept confidential.

11. Governing Law:

11.1 These terms and conditions are governed by the laws of New South Wales and the Commonwealth of Australia.

12. Allergic Reaction Terms

12.1 Prior to your booking please let us know if any medical concerns, allergies or injuries you may have. We offer FREE patch tests and consultations.Our cancellation policy applies where sensitivities are not brought up prior to you booking where the treatments or appointment cannot proceed.

12.2 IF during our consultation, we may discover that you may not be a candidate for a service and If you choose not proceed with the appointment due to a risk involved, a cancelation fee of the appointment will be charged. So again, please make sure you book in a PATCH TEST consultation if you are unsure about getting a treatment and would like to discuss the risks involved.

12.3 We do not recommend re-treatment under 5 weeks If you want to continue on own risk you have to sign the consent form.

13. Modifications to Terms:

13.1 Isabel Brows Academy reserves the right to modify these terms and conditions. Clients will be notified of any changes.

Schedule of Definitions:

  • Confidential Information: Includes all confidential information related to the business, structure, processes, methods, products, services, intellectual property, and other sensitive data, whether tangible or intangible.

  • Company: Refers to Isabel Brows Academy (hereinafter referred to as "the Company").

  • Contract: Implies a contract for the sale of services arising from an accepted order by the Company.

  • Course and Courses: Pertains to beauty-related vocational training courses provided or made available to Students by the Company.

  • Dispute: An unresolved claim arising under these terms and conditions.

  • Enrol and Enrolment: Signifies the act of a Student entering into a Contract with the Company for the supply of a Course.

  • Force Majeure Event: Includes events beyond the Company's control, such as natural disasters, pandemics, terrorism, or other unforeseeable events impacting the Company's ability to supply the Course.

  • Services: Encompasses educational materials, products, and services supplied by the Company.

  • GST: Refers to Goods and Services Tax as provided for in the applicable tax legislation.

  • Intellectual Property: Involves all intellectual property associated with the provision of Courses, including but not limited to copyright, trademarks, designs, trade secrets, and domain names.

  • Notice: Denotes written notice of a dispute in accordance with the specified clause.

  • Parties: Signifies the parties involved in these terms and conditions.

  • Refund: Implies a refund of the purchase services fee under the specified clause.

  • Services Address: Refers to [Your Academy's Email Address] and Shop 2, 1-3 Edgecliff Road, Woollahra, NSW, Australia 2025.

  • Services Fee: Denotes the total monetary amount payable for the purchase of products, including associated charges.

  • Terms: Encompasses the terms and conditions contained herein within this document.

  • Student: Represents any person who enrolls in a Course provided by the Company.

 

1. Background

1.1 The Company, Isabel Brows Academy, conducts business, offering beauty-related vocational training through face-to-face courses.

1.2 The Company provides Students with beauty-related vocational training, including but not limited to [Specify Courses Offered].

1.3 The Services are delivered through online access to pre-learning course content and face-to-face training at the Academy's premises in Woollahra, NSW.

2. Enrolment and Acceptance

2.1 The Company reserves the right to withdraw or cancel Courses based on financial viability.

2.2 Upon acceptance of a Student's enrolment, a Contract is formed.

2.3 The Company does not guarantee employment outcomes or specific satisfaction with Course content.

2.4 Upon receiving the Course Fees, Isabel Brows Academy provides access to online learning materials.

2.5 Students must not share login credentials associated with online Services delivery.

3. Course Fees and Refund

3.1 Students must pay a non-refundable Deposit at enrolment.

3.2 The balance of Course Fees is due two (2) weeks before the Course commencement.

3.3 In the event of rescheduling, Isabel Brows Academy will facilitate this if the Student provides more than two (2) weeks' notice before the Course commencement.

3.4 If the Student cancels their enrolment within two (2) weeks of the Course commencement, their Course Fees will not be refunded.

3.5 The Student acknowledges that they are not entitled to a refund of any monies paid after the commencement of the course if they elect to withdraw from the course.

3.6 All amounts are in Australian dollars and include GST. Isabel Brows Academy is not responsible for exchange rate fluctuations or changes in GST rates and reserves the right to increase the gross price should GST and/or any other rates increase.

3.7 The Student understands that the pricing structure, payment methods, payment processes, and these Terms and Conditions may be amended at any given time at Isabel Brows Academy's sole discretion.

4. Intellectual Property

4.1 The Student understands that Isabel Brows Academy owns all intellectual property rights in the materials and resources provided, and that nothing in these Terms and Conditions constitutes a transfer of any intellectual property ownership rights in the materials, except where Isabel Brows Academy has expressly authorized the transfer and the authorization is evidenced in writing.

4.2 The Student must not breach the copyright or intellectual property rights of Isabel Brows Academy by:

a. Altering or modifying any of the materials.

b. Copying or reproducing the materials without the written consent of Isabel Brows Academy.

c. Creating derivative works from the materials.

d. Sharing or making the materials available to or accessible by any third party.

e. Using any materials for commercial purposes such as on sale to third parties.

4.3 The Student is permitted to record their sessions for the sole purpose of learning in accordance with the course and these Terms; however, the Student is strictly prohibited from disseminating any Materials or sessions to any third parties.

4.4 The obligations under this clause will survive termination of these Agreement.

5. Confidential Information

5.1 The Student agrees not to disclose any private or confidential information ('Confidential Information') to any third party and to use all reasonable endeavors to protect Confidential Information from any unauthorized disclosure.

5.2 The Student agrees to only use the Confidential Information for the purpose for which it was disclosed or provided by Isabel Brows Academy and not for any other purpose.

5.3 The obligations under this clause will survive termination of these Agreement.

6. Student Conduct and Behavior

6.1 Isabel Brows Academy may provide the Student with any code of conduct or other policies concerning the Student's conduct and behavior. The Student is obliged to familiarize themselves with any such code or policy and abide by the same.

6.2 Without limiting clause 6.1, during their dealings with other students and Isabel Brows Academy personnel, the Student must at all times:

a. Behave in a courteous, fair-minded, and non-disruptive manner.

b. Not engage in any conduct that is abusive, unreasonable, discriminatory, or threatening or which amounts to harassment or stalking.

7. Marketing & Social Media

7.1 The Student is encouraged to provide feedback on the Course and their learning experience. Feedback may be used for marketing purposes. If a Student does not wish for their feedback to be used for marketing purposes, they should advise Isabel Brows Academy in writing.

7.2 The Student consents to Isabel Brows Academy taking photos and videos content during the course of the Course and uploading the content on their Social Media accounts and for the purposes of marketing.

7.3 Isabel Brows Academy agrees to the Student uploading the photo and video content on their Social Media, subject to clause 12.
